Notes |
- He appears as the complainant in an 1860 case in Ohio when he was seeking the return of a slave of his named Grandison Martin under the Fugitive Slave Act. The case pitted him against George Gordon, an abolitionist minister and president of Iberia College in Ohio, who claimed that it was a crime to arrest a fugitive. Others in his close family, including his father-in-law Rev. James Savage, had become convinced by then of the cause of abolition.
According to the original complaint:
Whereas, complaint has this day been made before me, Edward R. Newhall , a United States Commissioner, appointed by the Circuit Court of the United States, of the Seventh Judicial Circuit, and Southern District of Ohio, upon the oath of Isaac Pollock, that Grandison Martin, a person owing service and labor to the said Isaac Pollock, in the State of Kentucky, and under the laws of the said State, did, on or about the fifth day of May, A.D. 1860, escape from the service of the said Isaac Pollock, at Germantown, in Mason County, in the State of Kentucky, and from and out of the State of Kentucky, and into the State of Ohio, without the
knowledge or consent of the said Isaac Pollock. These are, therefore, to command you, in the name and by the authority aforesaid, to take the said Grandison Martin, if he be found within the State of Ohio, or if he shall have fled, that you pursue after him into any other District, and take and safely keep him so that you have his body forthwith before me, to answer the said complaint and be further dealt with according to law.
Given under my hand and seal, in the City of Cincinnati, 19th day of September, A.D. 1860.
Gordon apparently rescued and was present when U.S. Marshal Joseph Barber arrived to arrest Martin. At this point locals took Barber away and beat him to prevent Grandison's arrest. Gordon was present, and accused of doing nothing to help Barber. He was convicted on 6 Nov. 1861, and jailed and fined, but Lincoln pardoned him soon afterwards, in April of 1862. The case is often noted in histories of the Fugitive Slave Act, such as Stephen Middleton, The Black Laws: Race and Legal Process in Early Ohion (2005): 239-40. [8]
