Obituary | Family history says that he was killed in a saloon by a drunk named Foster. This article appeared in the Southern Banner (Brenham, Washington Co., Texas), 18 Oct. 1878. KILLING NEAR BELLVILLE On Sunday Morning at < > o'clock a difficulty accured [sic] at the German fest on Piney, two miles below Bellville, between Scurry Foster, of Buckhorn, Austin county, and Claus Umbland, of Chappell Hill, in which the latter was shot and killed by Foster. The ball entered the right breast between the shoulder and nipple, causing death in about one hour. After Umbland was shot and had fallen some of his friends went to him and found a larger pocket knife open and grasped in his hand. Sheriff Langhammer, of Austin County, and deputy sheriff Lewis, arrested Foster on the spot and at 2 o'clock on Sunday evening committed him to the Bellville jail. Our report was unable to learn any particulars as to the cause of the difficulty. Justice Blake held an inquest over the body, the jury returning a verdict that 'The deceased came to his death from a pistol show wound at the hands of Scurry Foster.' Umbland was an old and well known citizen of Chappell Hill. Foster is said to be a quiet, unoffensive [sic] man and is an old citizen of Austin county. The deceased was and Foster is a young man." Newspaper reports say that the trial was held in Bellville on July 14, 1880. According to an article in the Brenham Weekly Banner on 29 July 1880 — Brenham is a bit north of Bellville — "Scurry Foster, tried for the murder of Claus Umbland, was acquitted, not resulting in a mistrial as previously reported." And, "The Hempstead Courier says the Germans of Austin county are indignant at the acquittal of Scurry Foster, who killed Umbland." | |
